Terms of Service

Welcome to BossPaws. These Terms of Service ("Terms") govern your access to and use of the BossPaws platform, including the website at bosspaws.ai, the web application at app.bosspaws.ai, and the BossPaws mobile applications for iOS and Android (collectively, the "Service"), operated by FlexPilot Inc., doing business as BossPaws™ ("BossPaws," "we," "us," or "our").

Please read these Terms carefully before using the Service. By creating an account or using the Service, you agree to be bound by these Terms, our Privacy Policy, and our Cookie Policy. If you do not agree to these Terms, do not use the Service.

1. Service Description

BossPaws is an AI-powered pet care companion platform that provides:

• AI-driven pet health guidance and general care advice
• Pet profile management and health record storage
• Veterinary document, photo, and video analysis using artificial intelligence
• Pet care scheduling, reminders, and alarm notifications (PawAlert)
• Health tracking and insights dashboards
• Gamification and engagement rewards

2. Eligibility and Account Registration

2.1 Eligibility

You must be at least 18 years of age to create an account and use the Service. By creating an account, you represent and warrant that:

• You are at least 18 years old.
• You have the legal capacity to enter into these Terms.
• You will provide accurate and complete information.

2.2 Account Rules

• One account per person. You may not create or maintain more than one account.
• Accurate information. You must provide accurate, current, and complete registration information and keep it updated.
• Account security. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• Unauthorized access. You must notify us immediately at [email protected] if you become aware of any unauthorized use of your account.
• No sharing. You may not share your account credentials with any other person or allow others to access the Service through your account.

3. Subscription Plans, Pricing, and Auto-Renewal

3.1 Available Plans

All prices are in United States Dollars (USD).

3.2 Free Plan

The Boss Free plan provides limited access to the Service at no cost. Free plan AI message limits are lifetime limits that do not reset. Additional features and higher limits are available through paid subscriptions.

3.4 Payment Methods

Payment processing varies by platform:

• Web (app.bosspaws.ai): Processed by Stripe. Your payment information is collected and stored securely by Stripe in compliance with PCI DSS Level 1 standards. BossPaws does not store your credit card or payment details. You will receive a confirmation email after each charge.
• iOS (Apple App Store): Processed by Apple through your Apple ID account, subject to Apple's terms and conditions. Payment will be charged to your iTunes Account upon purchase confirmation. Subscription automatically renews unless turned off at least 24 hours before the end of the current period.
• Android (Google Play Store): Processed by Google through your Google account, subject to Google's terms and conditions.

After subscribing, you will receive a confirmation email or notification that includes your subscription plan and price, the auto-renewal terms, and instructions on how to cancel.

3.5 Cancellation

You may cancel your subscription at any time. Cancellation is designed to be as simple as the signup process:

• Web subscriptions: Through Settings > Billing in your account, or by emailing [email protected]. Cancellation takes effect immediately for future renewals.
• iOS subscriptions: Through your device Settings > Apple ID > Subscriptions. You must cancel at least 24 hours before your renewal date.
• Android subscriptions: Through Google Play > Payments & subscriptions > Subscriptions.

Upon cancellation:

• Your paid features remain accessible until the end of your current billing period.
• After your current period expires, your account reverts to the Boss Free plan.
• Your data (pet profiles, saved conversations within free plan limits) is retained.
• You will receive a confirmation of your cancellation.

3.6 Price Changes

We reserve the right to change subscription prices. If we change prices:

• We will provide at least 30 days' advance notice to active subscribers before the new price takes effect.
• The new price will apply at your next renewal after the notice period.
• If you do not agree with the new price, you may cancel before the renewal date.

3.7 Refunds

• Web (Stripe): Contact [email protected] within 14 days of a charge to request a refund. Refund requests are handled on a case-by-case basis.
• iOS: Refunds are handled exclusively by Apple per their refund policy. Request refunds through Apple Support or reportaproblem.apple.com.
• Android: Refunds are handled exclusively by Google per their refund policy. Request refunds through Google Play.

4. Acceptable Use

4.1 You Agree To:

• Use the Service only for its intended purpose of pet care guidance and management.
• Provide accurate information about your pets to receive the most relevant AI guidance.
• Comply with all applicable laws and regulations.
• Respect the intellectual property rights of BossPaws and third parties.

4.2 You Agree NOT To:

• Use the Service for any unlawful, fraudulent, or unauthorized purpose.
• Attempt to access other users' data, accounts, or any non-public areas of the Service.
• Attempt to reverse-engineer, decompile, disassemble, or extract the source code of the Service.
• Use automated scripts, bots, scrapers, or any automated means to access the Service.
• Attempt to extract, manipulate, or misuse the AI system, including prompt injection attacks, jailbreaking attempts, or efforts to make the AI generate harmful, illegal, or misleading content.
• Upload malicious files, viruses, malware, or harmful content.
• Circumvent, disable, or interfere with usage limits, security measures, or access controls.
• Resell, redistribute, sublicense, or commercially exploit the Service or its content without our prior written permission.
• Use the Service to generate content that is abusive, defamatory, threatening, or that violates the rights of others.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Use the AI to seek guidance for purposes that could harm any animal.

4.3 Enforcement

We reserve the right to investigate suspected violations and take appropriate action, including:

• Issuing warnings.
• Suspending or permanently terminating your account.
• Removing content that violates these Terms.
• Reporting illegal activity to law enforcement.

5. Intellectual Property

5.1 BossPaws Property

The Service, including its design, code, features, AI configurations, branding, logos, icons, 3D assets, and documentation, is owned by FlexPilot Inc. and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, create derivative works from, or otherwise use any part of the Service without our prior written permission.

5.2 Your Content

You retain full ownership of all content you upload to the Service, including pet photos, documents, videos, and the text of your messages ("Your Content").

By uploading Your Content, you grant BossPaws a limited, non-exclusive, royalty-free, revocable license to process, store, display (to you), and transmit Your Content solely for the purpose of providing the Service to you. This license includes transmitting Your Content to our AI providers for processing as described in our Privacy Policy.

This license terminates when you delete Your Content or your account (subject to the data retention periods described in our Privacy Policy).

We do not claim ownership of Your Content. We do not use Your Content to train AI models. We do not share Your Content with other users unless you explicitly initiate sharing through features such as PawAlert care sharing.

5.3 AI-Generated Content

Content generated by the AI in response to your interactions ("AI Output") is provided for your personal use in connection with your pet's care. AI Output may be similar to output generated for other users given similar inputs. You may use AI Output for your personal, non-commercial purposes. You may not commercially redistribute AI Output at scale without our prior written permission.

5.4 Feedback

If you voluntarily provide suggestions, ideas, or feedback about the Service ("Feedback"), you grant us a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use that Feedback for any purpose, including improving the Service, without compensation or attribution to you.

6. AI Processing Consent

By using BossPaws, you acknowledge, understand, and consent to the following:

• Your messages, photos, documents, and videos may be transmitted to Anthropic (Claude API) and/or Google (Gemini API) for AI processing.
• These AI providers process your data solely to generate responses and, under their API terms of service, do not retain your data for model training.
• AI responses are generated automatically by machine learning systems and are not reviewed, verified, or endorsed by any veterinary professional, medical expert, or BossPaws staff member.
• AI responses may contain errors, inaccuracies, omissions, or information that is not applicable to your specific pet or situation.
• AI responses must never be treated as a substitute for professional veterinary advice, diagnosis, or treatment.
• You are solely responsible for evaluating the accuracy and applicability of AI-generated content and for any actions you take based on it.

7. Limitation of Liability

7.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

WE DO NOT WARRANT THAT:

• The Service will be uninterrupted, timely, secure, or error-free.
• AI-generated content will be accurate, complete, current, reliable, or suitable for any particular purpose.
• Any health or care guidance provided by the AI is medically accurate, complete, or appropriate for your specific pet.
• Defects in the Service will be corrected.
• The results obtained from using the Service will meet your requirements or expectations.

7.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FLEXPILOT INC. (DOING BUSINESS AS BOSSPAWS), ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of or inability to use the Service.
• Any loss of profits, revenue, data, use, goodwill, or other intangible losses.
• Any damages arising from your reliance on AI-generated content, including but not limited to decisions regarding your pet's health, diet, exercise, or medical care.
• Any damages resulting from unauthorized access to, alteration of, or loss of your data.
• Any damages resulting from the conduct or content of any third party on the Service.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU HAVE PAID TO BOSSPAWS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100 USD).

7.3 Pet Health Liability Exclusion

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

1. BOSSPAWS IS NOT A VETERINARY SERVICE AND DOES NOT EMPLOY OR CONTRACT WITH LICENSED VETERINARIANS FOR THE PURPOSE OF PROVIDING VETERINARY CARE.
2. AI-GENERATED CONTENT IS NOT A SUBSTITUTE FOR PROFESSIONAL VETERINARY ADVICE.
3. ANY ACTIONS YOU TAKE OR FAIL TO TAKE REGARDING YOUR PET'S HEALTH, DIET, EXERCISE, MEDICATIONS, OR MEDICAL CARE BASED ON INFORMATION PROVIDED BY THE SERVICE ARE ENTIRELY AT YOUR OWN RISK.
4. BOSSPAWS SHALL HAVE NO LIABILITY WHATSOEVER FOR ANY INJURY, ILLNESS, HARM, DEATH, OR OTHER ADVERSE OUTCOME AFFECTING YOUR PET ARISING FROM YOUR USE OF OR RELIANCE ON THE SERVICE.

7.4 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our warranties and liability shall be limited to the maximum extent permitted by applicable law.

8. Indemnification

You agree to indemnify, defend, and hold harmless FlexPilot Inc. (doing business as BossPaws), its officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees and court costs) arising from or related to:

• Your use of or access to the Service.
• Your violation of these Terms or any applicable law.
• Your violation of the rights of any third party.
• Content you upload or transmit through the Service.
• Any claim that Your Content infringes the intellectual property or other rights of any third party.

9. Termination

9.1 Termination by You

You may terminate your account at any time by:

• Using the account deletion feature in Settings > Account Actions.
• Contacting [email protected].

See our Privacy Policy, Section 7 for details on the immediate account deletion process.

9.2 Termination by BossPaws

We may suspend or terminate your account, with or without prior notice, if:

• You materially violate these Terms or our Acceptable Use policy.
• Your account is used for fraudulent, abusive, or illegal activity.
• We are required to do so by law, regulation, or court order.
• We discontinue the Service (with at least 30 days' advance notice to active subscribers).

9.3 Effect of Termination

Upon termination:

• Your right to access the Service ceases immediately.
• Active paid subscriptions must be cancelled separately to avoid further charges (see Section 3.5).
• Your data will be handled in accordance with our Privacy Policy data retention and deletion procedures.
• The following provisions survive termination: Sections 5 (Intellectual Property), 7 (Limitation of Liability), 8 (Indemnification), 10 (Governing Law), and any other provisions that by their nature should survive.

10. Governing Law and Dispute Resolution

10.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein, without regard to conflict of law principles.

10.2 Dispute Resolution

Any dispute, claim, or controversy arising from or related to these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation by contacting [email protected].

If a dispute cannot be resolved through negotiation within 60 days, either party may submit the dispute to the exclusive jurisdiction of the courts of the Province of Ontario, Canada.

10.3 Class Action Waiver

To the maximum extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action or proceeding. You waive any right to participate in a class action against BossPaws.

11. General Provisions

11.1 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and FlexPilot Inc. regarding your use of the Service and supersede all prior or contemporaneous agreements, representations, and understandings.

11.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

11.3 Waiver

Our failure to enforce any provision of these Terms at any time shall not constitute a waiver of that provision or our right to enforce it in the future.

11.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction, including in connection with a merger, acquisition, or sale of assets.

11.5 Force Majeure

We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, acts of government, pandemics, internet or infrastructure disruptions, power outages, or third-party service outages.

11.6 Modifications to These Terms

We reserve the right to modify these Terms at any time. When we make material changes:

• We will update the "Last Updated" date at the top of these Terms.
• We will provide prominent notice through the Service at least 30 days before the changes take effect.
• Where required by law, we will obtain your consent.

Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and delete your account.

11.7 Electronic Communications

By creating an account, you consent to receive electronic communications from us (e.g., email, in-app notifications) related to your account and the Service. These communications are considered "in writing" for legal purposes. Transactional communications (account verification, password reset, billing confirmations) are not marketing and cannot be opted out of while maintaining an active account.
